Site Terms & Conditions:

Registration is essential on the day with payment required on the day (cash or approved cheque or electronic funds transfer), unless prior arrangement with Nutrien Ag Solutions has been made. Please note: 10% GST will be applied to all items sold. 

The Broadford and Seymour Depots are active operational work sites.

Visitors enter the site/s at their own risk.

To the extent permitted by law, Council accepts no liability for injury, loss or damage arising from attendance at the site.

 For the safety of all attendees, the following conditions apply:

  • No children under 16 years of age are permitted
  • No animals are permitted
  • Closed-toe footwear must be worn
  • Visitors must follow all site signage, safety directions, and instructions from authorised staff
  • Designated pedestrian walking paths must be used where provided
  • All visitors are required to sign in upon entry to the site
  • All incidents or observed hazards will be reported to Council staff in timely fashion

Failure to comply with these conditions may result in removal from the site.

By signing into the site, visitors acknowledge and agree to comply with these Terms & Conditions and all site safety requirements.

 

Buyers (Successful Bidder) Terms & Conditions:

To the extent permitted by law, Council accepts no liability for injury, loss or damage arising from attendance at the site including, but not limited to:

  • Buyer accepts all risks associated with dismantling, removal, transport, storage and reassembly of items, including injury, damage to property, structural collapse, environmental exposure, and damage to third party property – appropriate insurance will be held by the buyer to cover any eventuality
  • Buyer agrees to indemnify, defend and hold harmless the seller/auctioneer, site owner, employees, agents, contractors and affiliates from claims, liabilities, losses, damages, costs (including legal fees), arising from buyer’s removal activities, negligence, breach of waiver, or third‑party claims
  • Items are sold “as‑is, where‑is” with no express or implied warranties (including fitness for purpose, merchantability, completeness) and buyers are responsible for inspection of items prior to purchase
  • Buyer releases the seller/auctioneer and site owner from any current or future claims (including personal injury, property damage, economic loss) arising from the bought items or their removal
  • Buyer liable for any damage to site infrastructure (flooring, paving, fences, services) caused by removal activities; obligation to repair or reimburse costs.
  • Buyer acknowledges items may contain hazardous materials (asbestos, lead, oils, batteries, refrigerants, chemicals).
  • Buyer is responsible for identifying, testing (where required), and safely handling, removing, and disposing of hazardous materials in compliance with law
  • Buyers must supply their own tools/equipment in safe working order
  • load limits and ground-bearing capacity will be considered in the lifting and transport of loads; use of proper lifting gear and tag/certified slings or chains.
  • Lift plans for heavy or complex lifts (e.g., cranes, forklifts) and provision of certified lift SWMS’s will be developed by the buyer or any contractor they engaged and supplied to the site manager on request.
  • Where appropriate Buyer must have spill kits, dust suppression, and containment measures in place for any potential spills or releases
  • Buyer responsible for removal and lawful disposal/recycling of waste and debris
  • Buyer is responsible for obtaining any required permits for transport (oversize loads, road closures) and traffic management to transport their purchase
  • If buyer uses contractors, the buyer remains fully responsible for contractor acts/omissions; contractors must comply with insurance, licensing and site rules and be prepared to supply these on request.
  • Buyer agrees to immediate reporting of incidents or hazards and the remediation of incidents, damage, spills, or releases.
